Three Types of Spousal Financial Support Under Pennsylvania Law
Pennsylvania recognizes distinct forms of financial support depending on where you are in the divorce process. Each carries different eligibility rules, timelines, and defenses.
Spousal Support
Available once spouses separate, before any divorce complaint is filed. The paying spouse can challenge a spousal support claim by demonstrating marital fault on the part of the requesting spouse. Support terminates when a divorce complaint is filed, upon reconciliation, if the recipient begins cohabiting with a new partner, or upon the death of either party.
Alimony Pendente Lite (APL)
APL (Latin for “alimony pending litigation”) becomes available once a divorce complaint is filed and continues until the divorce decree is entered, including any appeal period. Unlike spousal support, APL can’t be defeated by a fault defense. Its purpose is to maintain financial balance between the parties while the divorce is pending.
Post-Divorce Alimony
Ordered as part of the final divorce decree when one spouse demonstrates financial dependence and a need for support beyond the divorce. Rehabilitative alimony is the most common form: a set-term award that gives the supported spouse time to gain education or job training toward self-sufficiency. Permanent alimony is rare and typically reserved for situations where the supported spouse can’t reenter the workforce due to age, illness, or disability. Pennsylvania doesn’t distinguish by gender; either spouse may file a support claim.
