How Pennsylvania Defines an Uncontested Divorce
Pennsylvania’s uncontested divorce process is most commonly pursued under the mutual consent ground, codified at 23 Pa.C.S. Section 3301(c). Both spouses must affirm that the marriage is irretrievably broken, defined under the Domestic Relations Code as estrangement due to marital difficulties with no reasonable prospect of reconciliation, and each must file an Affidavit of Consent with the court.
Before the court finalizes the divorce, all ancillary issues must be resolved: division of marital property and debts, child custody and visitation arrangements, child support obligations, and alimony where applicable. These terms are typically documented in a marital settlement agreement, sometimes called a property settlement agreement, which becomes part of the divorce record. For couples who have lived separate and apart for at least one year, Pennsylvania also recognizes a no-fault separation path under Section 3301(d). An attorney can help you determine which ground fits your circumstances.
Filing an Uncontested Divorce at the Bucks County Court of Common Pleas
To file for divorce in Pennsylvania, at least one spouse must have lived in the state for six months before filing. The divorce complaint is filed with the Bucks County Court of Common Pleas, and all family court filings, including the initial complaint and subsequent documents, are processed through the Bucks County Prothonotary’s office in Doylestown.
Under Pennsylvania Rules of Civil Procedure, both parties must wait 90 days from the date of service of the complaint before filing their Affidavits of Consent. That waiting period is a procedural minimum, not a guaranteed timeline for when the divorce can be final. During those 90 days, both spouses work through and document their agreements on property, custody, support, and alimony. Once the Affidavits of Consent and all required documents are filed and the record is transmitted, the court issues the final divorce decree. Missing or incorrectly prepared documents can delay that approval, which is one reason having an attorney review every filing before submission matters.
Why Legal Guidance Still Matters in an Amicable Divorce
An uncontested divorce isn’t necessarily an uncomplicated one. An improperly drafted property settlement agreement can have real long-term consequences, even when both spouses agree at the time of signing. Without legal guidance, couples sometimes overlook issues Pennsylvania law requires them to address, including retirement account division under equitable distribution principles, debt allocation, and tax implications tied to how assets are transferred.
Emotions complicate judgment even in an amicable separation. When you’re in the middle of it, evaluating whether an agreement is truly fair is harder than it looks. Attorney Blitshtein takes the time to understand each client’s full situation before drafting or reviewing any document. All consultations are held in strict confidence, and you can reach our attorneys and staff throughout your case, not just at the intake stage.
